Pinch of This ("Service," "we," "us") respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy explains how to submit a takedown notice, how we respond, and how a user whose content has been removed may file a counter-notice.

Because users save and import recipe content into their personal accounts, we rely on the DMCA safe harbor provisions of 17 U.S.C. § 512(c). Maintaining that safe harbor requires us to act expeditiously when we receive a valid takedown notice.

This agent is registered with the U.S. Copyright Office. Only DMCA notices should be sent to this address; other inquiries will not receive a response.

Submitting a Takedown Notice

If you believe that content stored on Pinch of This infringes your copyright, please send a written notice to our DMCA agent that includes ALL of the following:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • Identification of the copyrighted work(s) claimed to have been infringed (e.g., a URL to the original recipe or a description of the published work).
  • Identification of the material on Pinch of This that you claim is infringing, with enough detail for us to locate it (e.g., the recipe title as saved and the account email if known).
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement made under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Incomplete notices will not be acted upon. Submitting a false or misleading notice may expose you to liability under 17 U.S.C. § 512(f).

How We Respond to Notices

Upon receipt of a complete, valid takedown notice we will:

  • Promptly disable access to or remove the identified content from the affected user's account.
  • Notify the affected user that their content has been removed and why.
  • Provide the user with a copy of the takedown notice (with your personal contact information redacted if requested).
  • Forward any valid counter-notice to you, after which you have 10 business days to seek a court order before we restore the content.

We may also, at our discretion, terminate the accounts of users who are repeat infringers.

Counter-Notice Procedure

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to our DMCA agent that includes:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the district in which you reside (or, if outside the U.S., any judicial district in which Pinch of This may be found), and that you will accept service of process from the person who provided the original notice.

Upon receipt of a valid counter-notice, we will send a copy to the original complainant. If they do not notify us within 10 business days that they have filed an action seeking a court order, we will restore the removed content.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Pinch of This maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We track valid takedown notices received per account. Users who accumulate multiple valid notices, or who are found to have systematically imported infringing content, may have their access to the Service suspended or permanently revoked.

Limitations of This Policy

This policy applies only to content stored in user accounts on Pinch of This. It does not apply to:

  • Recipes that users have entered manually using their own words.
  • Content hosted on third-party websites that users link to without importing.
  • Pinch of This's own original content, marketing materials, or interface design.
